 Welcome to the official policies for VOWII AI MARKETING (PTY) LTD. This page serves as our master agreement and outlines the rules governing our digital services. It includes our Terms and Conditions, which detail our onboarding workflows, service delivery, and intellectual property rights; our Refund Policy, which explains the strictly non-refundable nature of our customized, automated AI digital goods once production begins; and our Cancellation Policy, which outlines the mandatory 20-business-day notice for monthly subscriptions alongside the pre-intake requirements for canceling once-off projects. By completing your payment and initiating a project with us, you formally acknowledge and agree to all guidelines detailed below. 

Terms and Conditions

1. Company Information

Welcome to VOWII AI MARKETING (PTY) LTD, a registered proprietary limited company in South Africa (Registration Number: 2026 / 135559 / 07). These terms and conditions govern your use of our website, vowiiaimarketing.co.za, and the purchase of our digital marketing services. Our registered operating address is Langham House, Fleet Street, Quigney, East London, Eastern Cape, 5201. The company is founded and directed by Mr. Jekie Mokwala.

2. Services and Pricing

We provide AI-driven marketing solutions categorized into once-off Core Products (e.g., Instant AI Web, AI Ad Spark, VOW Agent) and monthly Subscription Growth Engines (e.g., AI Content Engine, Outdoor Marketing). All prices are listed in South African Rands (ZAR). We reserve the right to modify our pricing structure; however, active monthly subscriptions will be notified of any changes prior to their next billing cycle. 

3. Onboarding and Service Delivery

Service delivery workflows commence immediately upon successful payment through our PayFast or Yoco payment links. Upon payment, clients are automatically redirected to an intake form (via Tally.so or Typeform) to upload necessary business details, logos, and raw images. It is the client's responsibility to provide accurate and timely information. Delays in submitting this intake data will result in corresponding delays in your project's start date on our internal ClickUp/Trello boards. 

4. Intellectual Property

 All digital assets created—including AI-generated website structures (via 10Web or Durable.co), ad creatives (via AdCreative.ai), and custom AI logic flows (via Voiceflow or Botpress)—remain the intellectual property of VOWII AI MARKETING until the final handover guide or digital Google Drive folder is transferred to the client.  

Refund Policy

1. Digital Services Exemption

Due to the immediate and proprietary nature of our AI-generated workflows—such as our 60-second website generation and rapid AI content bulk creation—our services are classified as customized digital goods. Under the South African Consumer Protection Act (CPA) and Electronic Communications and Transactions (ECT) Act, customized digital assets are generally exempt from standard cooling-off periods once performance has begun. Therefore, once your intake data is processed and our internal automation (via Make.com) triggers the project workflow, payments become non-refundable. 

2. Pre-Onboarding Refunds

If you have made a payment but wish to reverse the transaction before completing the automated intake form and initiating the project setup, you are entitled to a full refund. Please note that standard payment gateway transaction fees incurred via PayFast or Yoco may be deducted from the refunded amount.

3. Service Rectification

We are committed to the exact execution of our Standard Operating Procedures (SOPs). If a final delivered service (such as the AI Photo Pro upscales or Google Maps Domination review templates) severely deviates from the agreed scope, clients must notify us within 7 days of receiving the handover files via WeTransfer or email. We reserve the right to revise and rectify the digital assets to meet our agency standards before any partial or full refund is considered.  

Cancellation Policy

1. Monthly Subscriptions (Growth Engines)

For our monthly recurring services—including the AI Content Engine, Ad Spark Monthly, AI Niche Scout, and Outdoor Marketing subscriptions—clients are billed on a recurring basis. To cancel a monthly subscription, we require a standard 20 business days' written notice in accordance with South African consumer guidelines. This notice period allows our team to halt scheduled automated content (via Metricool), pause ad budgets (via Meta Advantage+), and safely close active AI agent integrations.

2. Once-Off Core Products

Cancellation of one-off services (e.g., the R499 Instant AI Web or the R749 VOW Agent) must be requested prior to the submission of your business details into our intake system. Once our creative team and internal AI agents have begun processing your provided data into tools like Jasper AI, Canva Magic Studio, or Topaz Photo AI, the project is considered actively in progress and cannot be cancelled.  

3. How to Cancel

 All cancellation requests must be submitted formally in writing to our official agency contact email. Upon receiving your cancellation request, a final statement will be provided confirming the termination of any linked Make.com or API automations connected to your business platforms (such as WhatsApp Business API or Google Business Profile).
